In August 2021, the South Dakota legislature unanimously approved a set of sports betting regulations at a hearing in Pierre. Last fall, South Dakota voters approved a measure that will allow sports betting on a retail-only basis at casinos in Deadwood. The first legal sports bets in South Dakota were placed in September 2021. Sports betting (online and in-person) is currently only allowed at approved casinos in Deadwood.

The South Dakota House State Affairs committee voted 10-3 to kill a bill that would have brought the question of online legalization before voters during the November 2022 election.

The voter-ratified constitutional amendment will also pave the way for the state’s federally recognized Native American tribes to open sportsbooks at their gaming properties and possibly online.

Currently, South Dakota has legal retail sports betting.

A measure to legalize online sports betting in South Dakota faltered in February. The House State Affairs committee voted 10-3 to kill a bill that would have brought the question of online legalization before voters during the November 2022 election. Under the prospective ballot measure, online sportsbooks would have to be controlled by or partnered with one of the four Deadwood casinos that currently offer the state’s only legal wagers.

The South Dakota Senate passed the bill earlier in February by one vote. An online sports betting measure could still appear on the 2022 ballot if it garners 33,921 signatures before May 3, though chances of that are slim.
